At least nineteen states are currently considering state False Claims Act statutes. This adds to state statutes in sixteen states, the District of Columbia, New York City and Chicago.

Many others will be considering False Claims Act statutes because the Deficit Reduction Act that took effect January 1, 2007 promises a ten percent increase in Medicaid distributions if a state has a False claims Act Statute that is essentially identical to the federal version. This will be a very fluid as the state statutes have to pass the HHS OIG review, which has already rejected several because they are not sufficiently similar to the federal statute.
